- Content: any textual or multimedia element on the Application, such as listings, ads, reviews, images, etc.
- Conditions: this agreement governing the relationship between the Owner and Users.
2. Relationships between the Owner, Third-Party Provider and Users
The Application hosts a platform managed by the Owner that connects Users interested in the Products offered by the Third-Party Provider. Where the Products are offered by Third-Party Providers, the Owner is not a party to the relationship established exclusively between Users and Third-Party Providers and assumes no liability arising from it, acting merely as the technical operator of the Application.
3. Scope of the Conditions
Use of the Application entails acceptance of the Conditions by the User. If the User does not intend to accept the Conditions and/or any other note, legal notice or policy published or referred to, they may not use the Application or its services. The Conditions may be amended at any time.
4. Registration
To use the features of the Application, Users must register by providing, truthfully and completely, all the data required in the registration form and by accepting the privacy policy (https://www.godot.work/privacy) and the Conditions in full. The User is responsible for keeping their access credentials confidential; these may be used exclusively by the User and may not be transferred to third parties.
5. Account deletion and closure
A registered User may stop using the Application at any time and deactivate their account or request its deletion through the Application interface, where possible, or by sending written notice to info@godot.work. In the event of a breach by the User of the Conditions or applicable law, the Owner reserves the right to suspend or close the User's account at any time and without notice.
6. Content submitted by Users
The User may upload Content to the Application provided it is not unlawful, misleading, or otherwise harmful to the Owner and/or third parties, and does not contain viruses, political propaganda, commercial solicitation, mass emails or any other form of spam. In the event of a claim by third parties, the User assumes full responsibility and undertakes to hold the Owner harmless from any damage, loss or expense.
7. Industrial and Intellectual Property Rights
All content of the Application, including texts, documents, trademarks, logos, images, graphics, their layout and adaptations, are protected by copyright and trademark law. Save for strictly personal use, it is not permitted to copy, alter, distribute, publish or use the Content without the specific authorisation of the Owner.
8. Disclaimer of warranty
The Application is provided "as is" and "as available" and the Owner gives no express or implied warranty in relation to the Application. The Owner will endeavour to keep the Application available 24 hours a day, but may under no circumstances be held liable if, for any reason, the Application is not accessible and/or operational at any time or for any period.
9. Limitation of Liability
The Owner shall not be liable to the User, except in the case of wilful misconduct or gross negligence, for disruptions or malfunctions connected with the use of the internet network outside its control or that of its suppliers. In no event shall the Owner be liable for an amount greater than twice the cost paid by the User.
10. Force majeure
The Owner shall not be held liable for the failure or delay in performing its obligations due to circumstances beyond its reasonable control caused by force majeure events. Performance of the Owner's obligations shall be suspended for the duration of the force majeure events.
11. Links to third-party sites
The Application may contain links to third-party sites/applications. The Owner exercises no control over them and is therefore in no way liable for the content of those sites/applications.
12. Privacy
The protection and processing of personal data will take place in accordance with the Privacy Policy available at https://www.godot.work/privacy
13. Applicable law and competent court
The Conditions are governed by Italian law. For professional users, the court of the Owner's registered office has jurisdiction over any dispute relating to the Application and to the performance and interpretation of these Conditions. For Consumer Users, any dispute shall be referred to the court of the place where the Consumer User resides or has elected domicile.
14. Online dispute resolution for Consumer Users
Consumer Users resident in Europe should be aware that the European Commission has set up an online platform providing an alternative dispute resolution tool, available at: ec.europa.eu/consumers/odr/.
General conditions for joining the e-marketplace
The E-marketer manages the Godot E-marketplace, which connects Users interested in the Products offered by the Third-Party Provider. The E-marketer acts as the operator of the E-marketplace and therefore remains at all times extraneous to the agreement concluded between the Third-Party Provider and the User. The signing of the Agreement by the Third-Party Provider is merely a request to join the E-marketplace.
The Third-Party Provider declares that it expressly approves, pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the clauses relating to: express termination in the event of breach, amendment of the Agreement, limitation/suspension/interruption of access, published content, obligations of the Third-Party Provider, assignment of the Agreement, exemption from liability, confidentiality, applicable law and competent court.
